Plain-English Summary

This bill requires healthcare providers and healthcare facilities to notify their patients if they use artificial intelligence (AI) to document medical visits, whether those visits are in-person or via telehealth. Additionally, the legislation mandates that the healthcare provider must review the AI-generated notes after the visit to ensure the documentation is accurate.

For younger readers

When you go to the doctor, they write down notes about how you are feeling. Sometimes doctors use a computer program called artificial intelligence, or AI, to help write these notes. This new rule says that doctors and hospitals must tell you and your parents if they are using this smart computer program to take notes during your visit. It also says the doctor must double-check the computer's notes after your visit to make sure everything it wrote down is correct.

Constitutional & Fiscal Check

None Likely. The bill regulates professional conduct and mandates consumer protection disclosures (notifying patients about AI use). Compelled commercial and professional speech of this nature, aimed at protecting patients and ensuring accuracy in medical records, easily passes constitutional scrutiny and does not violate First Amendment protections.

Bill Analysis

Both viewpoints
For Progressives
  • Promotes transparency and patient rights by ensuring individuals are informed about how their personal health data is being processed and documented by AI systems.
  • Protects vulnerable populations from potential AI biases or errors by legally mandating that human healthcare providers review the AI-generated documentation for accuracy.
  • Helps maintain a high standard of care within the community's healthcare system by ensuring that new technological efficiencies do not replace human oversight and accountability.
  • Does not explicitly require patient consent to use AI, only notification, which limits a patient's autonomy over their own healthcare data.
  • Lacks specific guidelines or penalties for failing to notify patients or correct inaccurate AI notes, potentially weakening the enforcement of these consumer protections.
  • Fails to address potential privacy concerns regarding where the AI data is stored or if third-party tech companies have access to sensitive medical information used to train the models.
For Conservatives
  • Imposes minimal regulatory burdens on healthcare businesses, allowing them to freely adopt innovative AI technologies to increase efficiency while simply requiring a basic notification.
  • Encourages personal responsibility and accountability by requiring healthcare professionals to review and stand by the accuracy of their own medical documentation.
  • Protects individual rights and privacy by ensuring patients are kept informed about how their sensitive medical visits are being recorded and processed.
  • Adds a new government mandate on private medical practices, dictating how doctors must communicate with their patients and manage their internal documentation processes.
  • The requirement to manually review all AI-generated documentation could reduce the time and cost-saving benefits of using AI, placing an administrative burden on healthcare businesses.
  • The broad definition of AI could lead to confusion and over-regulation, potentially stifling technological innovation and free enterprise in the healthcare sector.
