Plain-English Summary

This legislation mandates that starting August 1, 2026, all students participating in football within the Rhode Island Interscholastic League must wear impact-reducing soft-shell helmet covers during games and practices. School districts are required to purchase and supply these devices, which remain the property of the district. The bill includes an opt-out provision allowing parents, guardians, or students over the age of eighteen to decline wearing the device. The Rhode Island Interscholastic League is tasked with creating regulations for their use, and the state legislature may appropriate funds to assist schools with the costs.

For younger readers

This new law is about keeping kids safe when they play football for their school teams. Starting in August 2026, players will have to wear a soft, padded cover over their hard football helmets during practice and games. This cover helps cushion hits to the head. Schools have to buy these covers for the players. However, if a parent or guardian does not want their child to wear the extra cover, they are allowed to say no. The people in charge of school sports will make the rules on how to use them.

Bill Analysis

Both viewpoints
For Progressives
  • Prioritizes student health and public safety by mandating equipment specifically designed to reduce the risk of traumatic brain injuries and concussions among youth athletes.
  • Ensures equity in access to safety equipment by requiring school districts to furnish the devices, ensuring that students from low-income families are not excluded due to cost.
  • Acknowledges the need for state support by allowing the General Assembly to appropriate funds, potentially reducing the financial burden on local communities while promoting student welfare.
  • Includes an opt-out provision that undermines the universal safety goals of the legislation, potentially leaving students vulnerable to brain injuries based on parental discretion rather than medical best practices.
  • Lacks guaranteed funding as the bill only states the assembly "may" appropriate funds, potentially creating an unfunded mandate that strains the budgets of under-resourced public school districts.
  • Focuses resources and administrative energy on making a violent sport slightly safer, rather than addressing systemic issues in education funding or promoting non-violent athletic alternatives.
For Conservatives
  • Protects parental rights and individual liberty by including a clear opt-out provision, ensuring that parents—not the state—have the final say in the equipment their children wear.
  • Avoids a direct state takeover of sports regulations by delegating the creation of standards to the Rhode Island Interscholastic League rather than a government agency.
  • Does not mandate a specific state tax increase or appropriation, leaving the funding language permissive ("may appropriate") rather than mandatory.
  • Represents government overreach ("nanny state") by mandating specific equipment for voluntary sports, interfering with local school district management and athletic traditions.
  • Imposes an unfunded mandate on local municipalities and property taxpayers by requiring school districts to purchase equipment without a guarantee of state reimbursement.
  • Expands the regulatory burden on schools by requiring them to manage, track, and enforce the use of additional equipment, diverting focus from academics.

Changes to existing Rhode Island law · 24 additions

SECTION 1. Chapter 16-21 of the General Laws entitled "Health and Safety of Pupils" is hereby amended by adding thereto the following section: 16-21-44. Use of impact-reducing soft-shell helmet covers in interscholastic league football. (a)(1) Recent developments in sports technology have created soft shell helmet covers.

(2) These soft-shell helmet covers have been shown to reduce the impact of collisions in contact sports by adding a padded, soft-shell layer to the outside of a traditional hard-shelled football helmet.

(3) As used in this section, the term “device” shall refer to a soft-shell helmet cover that adds a padded, soft-shell layer to the outside of a traditional football helmet which layers are designed to reduce the impact of collisions to the body and the helmet, and thereby reduce the incidence and minimize the effects of concussions and other trauma to the body. (b)(1) Effective August 1, 2026, every student participating in the sport of football in the Rhode Island interscholastic league shall be required to wear an impact-reducing soft-shell helmet cover device at all times while participating in interscholastic league football games and practices during any time in which a traditional football helmet would be used. The devices shall be furnished by their respective school districts to all students participating in these sports; provided that, a parent, guardian, responsible adult, or a student who is eighteen (18) years of age or older, may elect to opt out of wearing these devices for practices or games, or both.

(2) These devices shall remain the property of the school district at all times.

(c) The Rhode Island interscholastic league shall promulgate rules, regulations and standards regarding the selection and use of these devices.

(d) The general assembly may, from time to time, appropriate funds to schools and school districts to aid in the purchase of these devices.

(e) The provisions of this section shall apply to all public school districts as well as any other school which participates in interscholastic league football.

SECTION 2. This act shall take effect upon passage.
