Plain-English Summary

This bill requires all healthcare providers and facilities, such as doctors, nurses, and hospitals, to inform their patients if they are using artificial intelligence (AI) to take notes or document their in-person or telehealth visits. Additionally, the healthcare provider must review the AI-generated notes after the visit to make sure they are accurate before finalizing the patient's medical record.

For younger readers

Sometimes doctors and nurses use smart computer programs called artificial intelligence, or AI, to help write down what happens during your checkup. This bill makes a rule that if your doctor uses a computer to take notes this way, they have to tell you about it first. The doctor also has to read over the computer's notes after your visit to make sure the computer didn't make any mistakes.

Constitutional & Fiscal Check

None Likely. The bill regulates professional medical conduct and commercial speech by requiring factual disclosures (notification of AI use) and standard of care practices (reviewing documentation for accuracy). Such regulations generally survive constitutional scrutiny as they serve a legitimate state interest in protecting public health and ensuring accurate medical records without infringing on fundamental rights.

Bill Analysis

Both viewpoints
For Progressives
  • Empowers patients with transparency regarding how their sensitive health data is being processed and recorded, promoting informed healthcare.
  • Mandating human review of AI-generated notes helps protect marginalized communities from potential algorithmic bias or errors that could negatively impact their medical care.
  • Establishes foundational accountability on the use of emerging technologies in healthcare, prioritizing patient welfare over corporate efficiency.
  • Fails to explicitly require patient consent to use AI, only requiring notification, which may leave vulnerable patients feeling powerless to opt out.
  • Does not include provisions addressing how AI data is stored, shared, or protected, potentially leaving patient privacy at risk of corporate exploitation.
  • Lacks specific penalties, oversight boards, or enforcement mechanisms to ensure that providers actually notify patients or adequately review the AI documentation.
For Conservatives
  • Protects the individual liberty and privacy of patients by ensuring they are informed when automated systems are monitoring and recording private medical consultations.
  • Maintains the traditional doctor-patient relationship by ensuring a human provider remains responsible for reviewing and verifying medical records rather than ceding control to machines.
  • Imposes a relatively minimal regulatory burden on healthcare businesses, requiring only a simple notification and review process without outright banning the use of efficient AI tools.
  • Introduces a new government mandate on private healthcare practices, dictating exactly how they must communicate with patients regarding their internal administrative workflows.
  • Adds mandatory review steps for healthcare providers, potentially bogging down operations, reducing efficiency, and increasing administrative costs for private medical businesses.
  • Opens the door to further government overreach and heavier regulations on private technology use in the healthcare sector, which could stifle corporate innovation.
