Plain-English Summary

This legislation mandates that health insurance policies in Rhode Island provide coverage for services rendered by licensed certified lactation counselors. Starting January 1, 2027, insurers must cover assessment, treatment, and education regarding breastfeeding for families and infants up to one year old. This coverage applies if the services are within the counselor’s scope of practice and if the insurer currently reimburses other providers for similar services. Insurers cannot require referrals unless they require them for other providers. Additionally, insurers must report cost and usage data regarding these services to the Office of the Health Insurance Commissioner annually.

For younger readers

This new law helps moms and their new babies. Sometimes, mothers need help learning how to feed their babies with their own milk. There are special helpers called lactation counselors who are trained to teach them how to do this. This law says that health insurance companies must pay for these helpers so families do not have to pay all the money themselves. This rule starts in the year 2027 and covers help for babies until they are one year old. It ensures moms get the support they need to keep their babies healthy.

Bill Analysis

Both viewpoints
For Progressives
  • Promotes health equity by ensuring that access to professional breastfeeding support is not limited to those who can afford to pay out-of-pocket, thereby supporting lower-income families.
  • Supports women and children by validating and funding essential postpartum care, potentially leading to better long-term health outcomes for infants and reduced healthcare disparities.
  • Expands the recognized healthcare workforce by mandating reimbursement for licensed certified lactation counselors, encouraging job growth in a care-focused sector.
  • Delays implementation until January 1, 2027, leaving families without guaranteed coverage for this essential service for several more years.
  • Contains exemptions for various types of insurance policies, such as limited benefit health and disability income plans, which may leave some individuals without coverage.
  • Includes a provision regarding "duplicate services" that insurance companies might exploit to deny claims if a doctor or nurse also provided incidental advice on feeding during a visit.
For Conservatives
  • Supports traditional family structures and maternal roles by providing resources that facilitate the natural rearing and health of infants.
  • May reduce long-term healthcare costs associated with formula feeding and infant illness, potentially lowering the overall financial burden on the healthcare system.
  • Encourages market competition by recognizing lactation counselors as distinct providers, potentially offering a lower-cost alternative to expensive physician-based consultations.
  • Imposes government mandates on private businesses (insurance companies) regarding what products they must sell, interfering with free market principles and contract freedom.
  • Likely increases health insurance premiums for all policyholders to subsidize the cost of these specific services, effectively redistributing costs to the general public.
  • Expands government bureaucracy by requiring insurers to submit annual utilization and cost reports to the Office of the Health Insurance Commissioner.
